Thank you for choosing MyDigiRecords. These Terms of Service (“Terms”) govern your access to and use of the MyDigiRecords and MyPetsRecords mobile applications and related services (collectively, the “Service”), operated by MyDigiRecords LLC (“we,” “us,” or “our”).

By creating an account or using any part of our Service, you agree to these Terms and our Privacy Policy.

If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 18 years of age to create an account and use the Service.
By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into this agreement.

2. Description of Service

MyDigiRecords provides digital tools for organizing, storing, and sharing personal health and wellness information.
Our features include health record management, medication tracking, immunization reminders, and general wellness insights via SmartVitals.

Important: MyDigiRecords is not a medical device and does not diagnose, treat, cure, or prevent any disease or medical condition.
All features, including SmartVitals, are for general wellness and informational purposes only. Always seek the advice of a qualified healthcare professional for any medical concerns.

3. Account Responsibilities:

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activity that occurs under your account

  • Ensuring the accuracy of the health information you upload

You agree not to share your password or allow unauthorized access to your account. You must promptly notify us of any unauthorized use or security breach.

4. User Content

You own the data and records you upload. By submitting content to the Service, you grant MyDigiRecords a limited, non-exclusive, and secure license to store, process, and transmit your data solely for the purpose of operating the Service.

You agree not to upload content that:

  • Violates any laws or third-party rights

  • Contains harmful software or malicious code

  • Includes data of others without their consent

5. Data Privacy

Our collection and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
We are committed to protecting your data through ISO 27001–certified security measures and encryption protocols.

6. Hardware & Third-Party Devices

Some features (such as SmartVitals) may require compatible smartphone sensors to function properly. MyDigiRecords does not manufacture, sell, or warrant the performance of any third-party smartphone or device. We are not responsible for errors, inaccuracies, or malfunctions in data received from such devices.

7. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We will make reasonable efforts to notify users of major changes. You agree that we are not liable for any modification or discontinuation of the Service.

8. Intellectual Property

All content, design, software, and trademarks within the Service are the exclusive property of MyDigiRecords LLC or its licensors.
You may not copy, modify, reverse-engineer, or distribute any part of the Service without our written consent.

9. Prohibited Conduct

You agree not to:

  • Use the Service for unlawful or fraudulent purposes

  • Attempt to interfere with or disrupt the Service

  • Access or collect data from other users without authorization

  • Use automated tools (bots, scrapers, etc.) to access the Service

Violation of these terms may result in suspension or termination of your account.

10. Termination

We may suspend or terminate your access to the Service immediately, without notice, if you breach these Terms or engage in prohibited activity.
You may stop using the Service at any time by deleting your account.

Upon termination, your right to use the Service will cease, but your data will remain protected and subject to our Privacy Policy.

11. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
MyDigiRecords makes no guarantees regarding:

  • Accuracy or completeness of data or insights

  • Compatibility with any specific hardware

  • Continuous or error-free operation

MyDigiRecords does not provide medical advice. All information is for general informational and wellness purposes only.

12. Limitation of Liability

To the maximum extent permitted by law, MyDigiRecords LLC and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of your use of the Service.

In no event shall our total liability exceed the amount you paid (if any) to use the Service in the 12 months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless MyDigiRecords LLC and its affiliates from any claims, damages, or expenses (including attorney’s fees) arising out of your:

  • Use or misuse of the Service

  • Violation of these Terms

  • Upload or sharing of health data or third-party information

14.  Changes to These Terms

We may update these Terms from time to time. Updates will be posted in the app and on our website with a revised effective date.
Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
